Florida based Atlas IP is suing Naperville and its Department of Public Utilities, saying they violated the “734 patent”, which Atlas invented and applied for in 1993.
This patent addresses the manner in which a smart meter hub controls communications between the remotes installed at residences and businesses within the network.
Chicago law firm Stadheim & Grear is representing Atlas, and maintains that though it is likely the violation was done unknowingly, it is still an infringement.
The damage award the company is seeking has yet to be determined. It is expected that the suit will not be litigated until early next year.
