A federal lawsuit has been filed by a Naperville woman who was acquitted last October of resisting or obstructing a Naperville peace officer.
Malia “Kim” Bendis is seeking damages from the City and penalties for the officers involved in her arrest back in January 2013. At that time, Bendis was filming city officials installing wireless smart meters at her friend Jennifer Stahl’s home, when she was handcuffed and placed under arrest.
The lawsuit is seeking a judgment against the officers and the city, “in a fair and just amount sufficient to compensate [Bendis] for the injuries she has suffered as well as other relief as is just and equitable.”
A court date for the suit has not yet been set.
Bendis is also involved in another federal lawsuit challenging the constitutionality of the smart meter program. That suit is still pending.
