A few weeks ago we brought you the story of two women who underwent genetic testing for breast cancer.
And now the Supreme Court has made their decision on whether human genes can be patented.
In a unanimous decision the Supreme Court ruled that human genes found in nature cannot be patented, but synthetic genes can.
Myriad Genetics was at the center of the lawsuit as they hold a patent on the BRCA 1 and 2 genes, the mutations associated with a higher risk of breast and ovarian cancer.
The court says that Myriad finding the genes does not allow them to patent them, but did say the synthetic DNA the scientists created called cDNA does deserve patent protection.
Doctors are now hoping more companies will be able to offer the breast cancer gene test, thus lowering the cost.
