A hearing was held for the lawsuit filed by the Naperville Township Highway Commissioner.
Judge Bonnie Wheaton granted the defendant’s motion to dismiss the case on all counts, stating that it’s the Township Board’s discretion to approve the highway commissioner’s budget as they deem necessary.
This after the Township Highway Commissioner, Stan Wojtasiak, filed suit against the Township Supervisor and two trustees on the board after they voted to cut his budget to save costs. The deduction was equal to the amount of cost savings they would have seen had they entered into an intergovernmental agreement with the City of Naperville.
The suit asked for the cut funds to be restored in order to perform his job duties.
